Categories of community services

Community service can take two forms

Community Service Activities and Types of Community Service Work

Community service can take two forms

    Caregiving and Support: Assisting, caring for, facilitating, or entertaining people with disabilities, the elderly, orphans, or patients in welfare institutions or healthcare facilities.

    Academic and Educational Services: Performing academic work or providing educational services, such as teaching, research, or document translation.

    Skilled and Professional Work: Engaging in tasks requiring specialized knowledge or skills, such as craftsmanship, engine work, construction, computer-related tasks, or other professions.

    General Community Services: Performing general community service tasks, such as cleaning or developing public places, planting or maintaining forests or public parks.

    Public Campaigns and Donations: Donating blood or participating in campaigns/projects for social benefit.

    Other Activities: Any other tasks that do not conflict with the principles, conditions, and objectives of community service.

Community Service in Lieu of Fines

Community service in lieu of fines is an option for offenders who have been sentenced to pay a fine by the court but lack the financial means to do so. Instead, they perform community service for society, the community, or non-profit charitable organizations. The rate for deducting the fine is 500 Baht per day.

Community Service in Lieu of Fines

Any individual, not a legal entity, who has been fined under Section 30/1 of the Penal Code and lacks the funds to pay the fine is eligible. How Does the Court Order Community Service in Lieu of Fines? There are two scenarios

      When the court inquires and informs the offender of their rights, and the offender, lacking funds to pay the fine, wishes to perform community service, they can submit a petition using Form B.S.1. The court will facilitate or assist in preparing the petition and the personal history form (Form B.S.2) for submission. The court may then immediately order community service without the offender being detained.

      An offender whom the court has sentenced to a fine but who lacks the funds and later wishes to perform community service can submit a petition (forms are available from the court's public relations division). They should state their desire to perform community service in lieu of the fine on the petition form (Form B.S.1) and fill in their personal history on the defendant's history form (Form B.S.2), then submit it to the court.

What Does the Court Consider When Granting or Denying Permission?

The court will consider the offender's financial status, personal history, family background, environment, criminal record, and the nature of the offense, as well as the public benefit derived from the community service.

Who Supervises Community Service?

The court will order a probation officer, a government official, a government agency, or a non-profit charitable organization to supervise the work.

What Determines the Type and Duration of Work?

The court considers the offender's gender, age, history, religious beliefs, conduct, intelligence, education, health, mental state, habits, occupation, or the nature of the offense. This ensures suitability and avoids imposing an undue burden on the offender. Detailed regulations are set forth in the Judicial Administration of the Courts of Justice Regulation on Determining the Number of Hours Considered as One Day of Work and Guidelines for Community Service, B.E. 2546 (2003).
